These Terms of Service (“Terms”) govern your use of the Tifton Web Design LLC website at staging.tiftonwebdesign.com and, where applicable, your purchase or use of services provided by Tifton Web Design LLC (“Tifton Web Design,” “TWD,” “we,” “us,” or “our”).
By using this website, requesting services, accepting a proposal, or entering into a service relationship with Tifton Web Design, you agree to these Terms as applicable to your use of the website or services.
Specific projects or ongoing services may also be governed by a proposal, order form, statement of work, subscription agreement, invoice, or other written agreement. If a project-specific agreement conflicts with these Terms, the project-specific agreement controls for that service.
1. About Tifton Web Design
Tifton Web Design LLC provides managed creative and technology services for small and midsize businesses, including:
- Web design and managed websites
- Ecommerce and booking solutions
- Apps and custom software
- Workflow automation and integrations
- Graphic design and print production
- Digital marketing
- SEO and local visibility
- Email marketing and CRM-related services
- Ongoing hosting, maintenance, support, and technology management
The exact services provided to a client are determined by the applicable proposal, agreement, or other written scope of work.
2. Website Use
You may use this website for lawful informational and business purposes.
You agree not to:
- Attempt to gain unauthorized access to the website, hosting environment, accounts, or systems
- Interfere with the operation or security of the website
- Submit malicious code, spam, fraudulent requests, or intentionally false information
- Use automated systems to abuse forms, scrape protected content, or disrupt website operation
- Copy, reproduce, or exploit Tifton Web Design content or intellectual property in violation of applicable law
- Use the website in connection with unlawful, fraudulent, abusive, or harmful activity
We may restrict or block access to the website when reasonably necessary to protect our systems, users, clients, or business.
3. Service Requests and Proposals
Submitting a form, requesting information, participating in a consultation, or receiving an estimate does not automatically create a client relationship or obligate Tifton Web Design to accept a project.
Before beginning substantial paid work, the parties may agree on matters such as:
- Scope of work
- Deliverables
- Pricing
- Deposits or activation fees
- Recurring charges
- Project schedule
- Client responsibilities
- Included revisions
- Hosting or support terms
- Minimum service periods
- Third-party expenses
- Ownership or licensing of deliverables
A proposal or estimate may expire if it is not accepted within the period stated in that document.
4. Fees and Payment
Fees are based on the services, scope, and payment structure agreed to with the client.
Depending on the engagement, Tifton Web Design may charge:
- One-time project fees
- Activation or setup fees
- Deposits
- Monthly recurring fees
- Hourly charges
- Usage-based or third-party costs
- Printing, advertising, software, licensing, hosting, or other pass-through expenses
Payment terms, due dates, and applicable minimum commitments will be stated in the relevant proposal, invoice, or service agreement.
Amounts not paid when due may result in paused work, suspension of managed services, or other reasonable collection measures.
Unless otherwise stated in writing, fees already earned for completed work are non-refundable.
5. Recurring and Managed Services
Some Tifton Web Design services are provided on an ongoing or subscription basis.
Recurring services may include hosting, maintenance, security, software management, support, marketing, CRM, email, automation, analytics, or other managed technology.
The applicable service agreement will specify any:
- Minimum commitment
- Renewal terms
- Cancellation requirements
- Included support
- Usage limits
- Activation fees
- Early termination obligations
Cancellation of a recurring service does not cancel amounts already due or obligations that accrued before cancellation.
6. Client Responsibilities
Clients are responsible for providing accurate and timely information reasonably necessary to perform the work.
This may include:
- Business information
- Logos and brand assets
- Product or service details
- Prices
- Images and media
- Policies and legal disclosures
- Account access
- Domain or DNS access
- Platform credentials
- Feedback and approvals
- Content required for the project
Project timelines may be affected when requested information, access, approvals, or materials are delayed.
Clients are responsible for reviewing deliverables and notifying Tifton Web Design of errors, omissions, or requested corrections within any review period provided.
7. Accuracy of Client-Provided Information
Tifton Web Design may rely on information provided by the client when designing websites, advertisements, print materials, software, marketing campaigns, or other deliverables.
Clients are responsible for ensuring that information they provide is accurate, lawful, and appropriate for publication.
Tifton Web Design is not responsible for claims, pricing, representations, regulatory statements, copyrights, trademarks, or other content supplied or specifically approved by the client.
8. Accounts, Access, and Administrative Management
To provide managed technology services, Tifton Web Design may require administrative access to websites, domains, hosting platforms, email systems, analytics services, advertising platforms, software, or other accounts.
TWD may create or maintain administrative identities, credentials, recovery methods, and role-based access necessary to provide the contracted services securely and consistently.
Clients agree not to intentionally interfere with administrative access or technical configurations required for Tifton Web Design to provide active managed services.
When a service relationship ends, access and account transition procedures will depend on the applicable service agreement, the ownership of the account or asset, and the policies of the third-party provider involved.
9. Security and Backups
Tifton Web Design uses reasonable administrative and technical practices intended to improve the security and reliability of managed systems.
These measures may include:
- SSL
- Backups
- Software updates
- Access controls
- Authentication protections
- DNS management
- Security monitoring
- Firewall or network protections
- Recovery planning
However, no website, server, software application, network, or online account can be guaranteed to be completely secure or continuously available.
Tifton Web Design does not guarantee that a system will never experience hacking attempts, malware, data loss, service interruption, software defects, or other security incidents.
10. Third-Party Services
Tifton Web Design frequently uses third-party products and services when they are appropriate for a project.
Examples may include:
- WordPress
- Hosting providers
- Cloudflare
- Google services
- Payment processors
- Email providers
- CRM platforms
- WordPress themes and plugins
- Ecommerce services
- Print vendors
- Advertising platforms
- App stores
- APIs
- Cloud infrastructure
- Analytics tools
- AI-assisted tools
Third-party products and services are governed by their own terms, pricing, availability, privacy policies, and technical limitations.
Tifton Web Design cannot guarantee the continued availability, pricing, compatibility, features, policies, or performance of third-party services.
Where appropriate, we may recommend or implement alternatives if a third-party service materially changes or becomes unsuitable.
11. Software, Plugins, and Licenses
Some projects may use commercially licensed software, plugins, themes, APIs, fonts, stock assets, or other third-party intellectual property.
Unless otherwise stated in writing:
- Third-party products remain subject to their original licenses
- License availability may depend on an active TWD-managed service
- A third-party license may not be transferable to the client
- The client may need to purchase a separate license after managed service ends
- Future license-price increases may affect the cost of ongoing services
Tifton Web Design may substitute reasonably comparable tools when necessary to maintain compatibility, security, or supportability.
12. Intellectual Property
Client Materials
Clients retain ownership of materials they provide to Tifton Web Design, including their existing trademarks, logos, photographs, copy, data, and other client-owned content.
Clients represent that they have sufficient rights to provide those materials for use in the project.
Tifton Web Design Materials
Tifton Web Design retains ownership of its pre-existing intellectual property, including:
- Internal methods and processes
- Reusable code
- Development utilities
- Templates
- Frameworks
- Design systems
- Documentation
- Know-how
- Automation components
- Proprietary tools
Final Deliverables
Ownership and licensing of final project deliverables will be governed by the applicable project agreement.
Unless otherwise agreed, ownership transfer does not include third-party assets, licensed software, proprietary TWD tools, or reusable components that were not created exclusively for the client.
13. AI-Assisted Work
Tifton Web Design may use artificial intelligence or automation tools as part of research, ideation, development, design, analysis, editing, coding, or production workflows.
AI-assisted work remains subject to human review and direction by Tifton Web Design.
Because third-party AI services may have their own licensing, reliability, and technical limitations, Tifton Web Design does not guarantee that every AI-generated element will be unique or eligible for exclusive intellectual-property protection.
Sensitive client information will not knowingly be submitted to third-party AI systems when doing so would be inconsistent with applicable agreements or reasonable confidentiality expectations.
14. Contractors and Specialists
Tifton Web Design may use trusted contractors, vendors, or specialists when a project requires additional expertise, production capacity, or services outside TWD’s direct capabilities.
The client’s primary relationship remains with Tifton Web Design unless otherwise agreed.
Tifton Web Design remains responsible for coordinating work within the scope it has agreed to manage.
15. Printing and Physical Production
When Tifton Web Design coordinates printing or physical production, final results may vary slightly from digital previews because of factors such as:
- Paper or material
- Ink
- Equipment
- Finishing processes
- Color profiles
- Cutting tolerances
- Manufacturing variations
Clients are responsible for reviewing and approving proofs when approval is requested.
Once an approved job has entered production, changes or cancellations may not be possible and additional production costs may apply.
Third-party printer or manufacturer policies may also apply.
16. Marketing and Advertising
Tifton Web Design may provide SEO, advertising, content, social media, email marketing, reputation-management, and related services.
Marketing performance depends on many factors outside TWD’s control, including:
- Market conditions
- Competition
- Search algorithms
- Advertising-platform policies
- Customer behavior
- Pricing
- Product quality
- Business reputation
- Budget
- Offer quality
- Website conversion performance
We do not guarantee specific rankings, traffic levels, lead volumes, sales, revenue, follower counts, or return on advertising spend.
Advertising budgets and platform charges are separate from TWD management fees unless explicitly stated otherwise.
17. Search Engine Optimization
SEO recommendations and implementation are intended to improve technical quality, content relevance, usability, and search visibility.
Search engines independently determine rankings and may change their algorithms or policies at any time.
Tifton Web Design does not control search-engine indexing or ranking decisions and cannot guarantee any particular position in search results.
18. Custom Software
Custom software development may involve technical uncertainty, third-party dependencies, changing requirements, and discovery of additional complexity during development.
Where applicable, custom software projects may be divided into discovery, planning, prototype, development, testing, deployment, and ongoing support phases.
Material changes to the approved scope may require:
- Additional fees
- Revised estimates
- Extended timelines
- New technical requirements
Software may require ongoing maintenance as operating systems, APIs, browsers, platforms, and third-party services evolve.
19. Client Approval
When a client approves a design, proof, website, campaign, application, configuration, or other deliverable, Tifton Web Design may rely on that approval to proceed.
The client is responsible for reviewing important matters such as:
- Spelling
- Contact information
- Pricing
- Dates
- Product information
- Legal claims
- Visual content
- Links
- Functionality
- Print proofs
Corrections requested after final approval may result in additional charges.
20. Confidentiality
Tifton Web Design will use reasonable care when handling non-public business information received from clients.
Unless otherwise agreed, confidentiality obligations do not apply to information that:
- Is publicly available
- Was already lawfully known
- Is independently developed
- Is received lawfully from another source
- Must be disclosed under applicable law
Projects involving more extensive confidentiality requirements may use a separate nondisclosure agreement.
21. Portfolio and Promotional Use
Unless the client requests otherwise in writing or a separate agreement prohibits it, Tifton Web Design may identify completed client work in its portfolio, website, case studies, social media, proposals, or promotional materials.
This may include:
- Client name
- Logo
- Website screenshots
- Publicly available project imagery
- General descriptions of services performed
Tifton Web Design will not intentionally disclose confidential or sensitive client information as part of portfolio use.
22. Availability and Support
Tifton Web Design aims to provide responsive, dependable service, but does not guarantee immediate or continuous availability.
Support response time may depend on:
- Severity
- Service level
- Business hours
- Third-party availability
- Project workload
- The nature of the request
Unless a written service-level agreement states otherwise, no guaranteed response or resolution time applies.
23. Suspension or Termination
Tifton Web Design may suspend or terminate services when reasonably necessary because of circumstances such as:
- Nonpayment
- Fraud
- Abuse
- Illegal activity
- Security risk
- Material breach of agreement
- Repeated interference with managed systems
- Conduct that makes continued service unreasonable or unsafe
Where practical, we will attempt to provide reasonable notice and an opportunity to resolve the issue.
Either party may terminate services according to the terms of the applicable service agreement.
24. No Warranty
Except where expressly provided in a written agreement, services and website content are provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, Tifton Web Design disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms creates a guarantee of business results.
25. Limitation of Liability
To the fullest extent permitted by applicable law, Tifton Web Design will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the website or services, including loss of profits, revenue, data, business opportunities, or goodwill.
Except where prohibited by law or otherwise agreed in writing, Tifton Web Design’s aggregate liability arising from a particular paid service will not exceed the amount paid to Tifton Web Design for that service during the six months immediately preceding the event giving rise to the claim.
26. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Tifton Web Design LLC from claims, damages, liabilities, or expenses arising from:
- Materials or instructions you provide
- Your violation of law
- Your infringement of another person’s rights
- Misuse of services or deliverables
- Claims arising from products, services, representations, or business practices controlled by you
This provision does not require indemnification for liability caused solely by Tifton Web Design’s own unlawful conduct.
27. Force Majeure
Tifton Web Design is not responsible for delay or failure caused by events reasonably outside its control, including:
- Natural disasters
- Severe weather
- Power or internet outages
- Cyberattacks
- Government actions
- Labor disruptions
- Third-party outages
- Hosting failures
- Platform shutdowns
- Supply-chain problems
- Acts of war or terrorism
We will make reasonable efforts to resume affected services when practical.
28. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
Unless another written agreement states otherwise, disputes relating to these Terms or Tifton Web Design services will be handled in courts having appropriate jurisdiction in or serving Tift County, Georgia.
29. Changes to These Terms
Tifton Web Design may update these Terms as its services, technology, business practices, or legal requirements change.
The Last Updated date at the top of this page will reflect the most recent revision.
Changes will apply prospectively unless otherwise required by law.
